This agreement is between you the parent, student and MATH A PLUS ACADEMY hereinafter referred to as ‘MATH A PLUS ACADEMY’ or ‘We’.
If you do not agree with all the provisions of this agreement, you cannot use the Services. To remove any doubt, in the event of any conflict or discrepancy between these Terms of Use and any other provisions and/or terms and/or otherwise between MATH A PLUS ACADEMY and you, the provisions and the terms of these Terms of Use will prevail. Please feel free to contact us with any questions regarding the content of this agreement.
Therefore, the use of www.mathaplusacademy.com is subject to the following terms of use hereinafter referred to as “TOU” were the context so admits and our privacy policy.
MATH A PLUS ACADEMY reserves the right to update the TOU at any time without notice to the user. Each time you use the Site or subscribe to any of our plan, you reaffirm your acceptance of the then-current TOU, and your agreement to be bound hereby. You are responsible for staying informed of any changes and are expected to check this page from time to time so you are aware of any changes. The most current version of the TOU can be reviewed by clicking on the ‘Terms of Use’ hypertext link located at the bottom of our webpages.
1. ACCEPTANCE OF TERMS AND CONDITIONS.
1.1. The Services are intended only for use by the members of the general public who have agreed to these Terms and Conditions (“Permitted Users”, “You”, or “Your”), for purposes only in connection with the Services described herein. These TOU constitute a contract between you and us that governs your access and use of the Services. By accessing, viewing, or using the Services, you agree to these Terms and Conditions as may be modified from time to time and agree to be legally bound by them.
2. ABOUT OUR SERVICES
2.1 We are MATH A PLUS ACADEMY; a Limited liability company, MATH A PLUS ACADEMY is registered in Barbados under MATH A PLUS ACADEMY Company no 64773, MATH A PLUS ACADEMY’ registered office is at Queens Street St.Peter, Speightstown St.Peter Barbados.
At MATH A PLUS ACADEMY, we are committed to help the Learner reach his/her Peak. Our team ensure that every student gets the complete one-on-one attention that they deserve fo1r academic excellence in Mathematics. All our sessions are unique, and completely based on each tutee, at a pace that is right for them. We offer both online tutoring and in person tutoring for our registered and subscribed users.
3. YOUR STATUS
3.1 By creating an account as a Learner on www.mathaplusacademy.com, you warrant that:
3.1.1 You are legally capable of entering into binding contracts;
3.1.2 You are at least 18 years old & if less than 18 you do so under the supervision of a Parent or Guardian; and;
3.1.3 You are ready to comply with the use of these TOU rendered herein.
4. USE OF THE WEBSITE’S SERVICES
4.1 Students must be logged into the website with their full name and shall give a brief introduction of their person and the purpose of using the platform.
4.2 During Online Class Sessions, The students Shall turn off all Microphones and Camera’s unless a question is being asked by the Tutor or the Student.
4.3 The Student agrees and acknowledges that there shall be no abusive and/or discriminatory languages on the platform. MATH A PLUS ACADEMY shall be within its right to take disciplinary action against such erring student.
4.4 MATH A PLUS ACADEMY will place a student under review if such student is found not to be partaking in sessions or completing task and/or take Home assignments.
4.5 All Online sessions shall be recorded and MATH A PLUS ACADEMY shall be within its rights to publish them on its various social media platforms.
5. USER ACCOUNTS
5.1 In order to create a user account as a student on the website, you must provide your full name, an email address, your country or region of residence, a public username, and a user password. You agree that you will never
divulge or share access or access information for your user account with any third party for any reason. In setting up your user account, you may be prompted to enter additional optional information (e.g., your year of birth). You represent that all information provided by you is accurate and current. You agree to maintain and update your information to keep it accurate and current.
5.2 MATH A PLUS ACADEMY cares about the confidentiality and security of your personal information. Please see the Privacy Policy for more information about the collection and use of data when using the website.
5.3 Learners must provide the following information to MATH A PLUS ACADEMY for registration at the Registration interface:

In order to submit a valid registration, the LEARNER must specify the password of his / her choice, which must be at least 8 characters long. For the valid registration, the registering LEARNER needs to accept MATH A PLUS ACADEMY' current TOU, Privacy Policy and cookies policy by ticking the check circle placed on the registration form, and to declare that he / she is at least 18 years old and if less, uses the site under the supervision of a Parent or Guardian.
5.4 MATH A PLUS ACADEMY shall not be held liable for any problem or error attributable to the incorrect and / or i inaccurate information provided by the LEARNER. The LEARNER may change the incorrectly / erroneously entered data during the registration after the login, after clicking on the "profile" button in the top right corner of the homepage.
6. FEES
6.1 The fee payable by the Learner for online Sessions (“Fee”) will be calculated and displayed to you on the course mode.
6.2 The acceptable mode of payment shall be done with the use of PayPal.
7. DISCLAIMERS AND OUR LIABILITY TO YOU
7.1 Nothing in these Terms shall exclude or limit our liability for:
7.1.1 Personal injury or death resulting from our negligence:
7.1.2 Fraud or fraudulent misrepresentation:
7.1.3 Or for any breach of the obligations implied by section 2 of the Supply of Good and Services Act 1982:
7.2 We cannot guarantee that this Website will be:
7.2.1 Compatible with all or any hardware and software which you may use:
7.2.2 Available all the time or at any specific time; or
7.2.3 Accurate and up to date.
7.3 We use industry standard techniques to protect our Website from bugs, viruses and attacks but cannot guarantee that our Website will be free from bugs, viruses, or other malicious software. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to your downloading of any content on it, or on any Website linked to it.
7.4 The content on the Website is provided for general information only and is not intended to amount to advice on which you should rely. Although we make reasonable efforts to update the information on the Website, we make no promises that the content on the Website is accurate, complete or up to date.

8. INTELLECTUAL PROPERTY RIGHTS
8.1 Save for User Content, all content published, displayed or performed on this Website (including, but not limited to text, lists, directories, graphics, photographs, images, illustrations, drawings, audio clips, video clips, interactive applications and search features) (“Website Content”) is protected by copyright, trademarks, database right and other intellectual property rights, which are owned or controlled by us or our third party licensors and content providers. Save to the extent expressly provided in the Terms of Use, you shall not obtain any right, title or interest in any of the Website Content.
8.2 You are not granted any commercial, copying, sale, resale, rental, lending, adaptation, reproduction, distribution, publication, modification, broadcast or promotional rights for the Website Content. You may not without our prior written consent (except to the extent required in order to use this Website in accordance with the Terms) use the Website Content for any purposes that require such rights, systematically extract any of this Website Content or in any way use or exploit commercially any of this Website Content. 9. USER CONDUCT AND CONTENT STANDARDS
9.1 These conduct and content standards apply to any and all images, drawings, video, audio, text, lists and other content you upload to, display on, or distribute or otherwise publish through, this Website (“User Content”) and your use of this Website.

9.5 Using the ratings or review functions of this Website to make personal attacks is not allowed. Under no circumstances may you attack a person based on the person’s race, national origin, ethnicity, religion, gender, sexual orientation, disability, age or other identification.
9.6 We reserve the right, without obligation, to monitor, moderate, edit or remove any content that you upload to this Website and to vet or screen users of this Website. However, you acknowledge that you use this Website at your own risk and you are responsible for the information you post on this Website.

10. SUSPENSION AND TERMINATION
10.1 Failure to comply with these Terms and, in particular, our User Conduct and Content Standards set out in paragraph 16 above constitutes a material breach of the terms upon which you are permitted to use this Website. If in our opinion you fail to comply with these Terms, it may result in our taking all or any of the following actions at our discretion:
10.1.1 Immediate withdrawal of your right to use this Website and any services available on the Website;
10.1.2 Immediate removal of any posting or material uploaded or otherwise transmitted by you to this Website;
10.1.3 Legal action against you including proceedings for reimbursement of any and all damages and costs resulting from the breach; or
10.1.4 Disclosure of such information to law enforcement authorities or third party complainants as we reasonably feel is necessary or required.
10.1.5 The responses described in this paragraph are not limited, and we may take any other action we reasonably deem appropriate.
10.2 We may, in our absolute discretion, suspend or terminate your access to all or part of this Website and the content and services available through it with or without notice. We may also terminate accounts that are inactive for more than six months or should the registration information you provided to us prove to be false or misleading.
10.3 Upon and following such termination or suspension:
10.3.1 The license to use this Website and its content and services shall immediately terminate;
10.3.2 We may deny you access to your account and services provided through this Website; and
10.3.3 We may deny you access to any information you have stored through this Website and this may not be retrieved later. You will not be able to recover any data on a deactivated account. We therefore recommend that you keep a copy of any information or User Content you store through this Website, if you want to be able to permanently access such information or User Content.

11.3 If we do not exercise or enforce any legal right or remedy which may be available to us in relation to you or another user of this Website, this will not be taken to be a formal waiver of our rights.
11.4 You are individually bound by these Terms even if you are using this Website on behalf of a company or other legal entity, regardless of whether that entity has any separate agreement with us.
11.5 If any provision of the Terms is or becomes illegal, invalid, or unenforceable that shall not affect the legality, validity or enforceability of any other provision of the Terms.
11.6 The Terms are governed by the laws of Barbados and the courts of Barbados will have exclusive jurisdiction in relation to any and all disputes arising from them.
